Return Policy

Our customer care policy is simple.  We will do everything we can to assure you are happy with your purchase.

Please contact us at hello@shoplavie.co or stop in store to initiate the return/exchange process.  We ask that you kindly provide a copy of your purchase confirmation or receipt.  If you do not have your purchase confirmation or receipt, please provide your first and last name, order number, date purchase was made and item/item # you are returning.  Please describe why you are wanting to return your merchandise.  The information you provide helps us better our business, our service and our products.

As soon as we receive your email, we will happily email you an USPS Mail return address label - La Vie Est Belle will cover the cost of return shipping.  We ask that you return your item in its original packaging and box.  Simply tape it back up, affix the label we provide and drop it off at your nearest USPS location or schedule a pick-up.  Your package will be on its way.  Once your item(s) are obtained by the carrier, USPS Mail typically takes 3-5 business days unless there is an unforeseen delay.  Once we receive your return and examine product/product condition, we will process your refund.  Please note refunds may not be seen in your bank account for approximately 10 business days.  If you initiated an exchange, we will send a replacement as soon as we receive the return or you are welcome to purchase a new replacement in advance of processing a return and refund. 

We do kindly ask that returns/exchanges be made within 30 days of purchase.  We do recognize that sometimes this window might extend around holidays.  We are a small retailer and ask for your consideration and kindness to help us manage inventory and operations.  But at the end of the day, we promise to do what is right.

Terms of Service

La Vie Est Belle and/or its affiliates (“La Vie Est Belle”, “we”, “us” or “our”) operate as an online store located at shoplavie.co and brick-n-mortar at 3417 Lake Elmo Ave. North, Lake Elmo, MN 55042 from which you may purchase products and participate in community events.

These Terms of Use apply to the content and functionality of La Vie Est Belle, and to the La Vie Est Belle products and services. These Terms of Use do not apply to products or services that we make available pursuant to different terms, such as our payment processing services, which are governed by Shopify Payments and  Stripe Services Agreement.

1. Information that you provide to us

You may give us information about yourself when you visit La Vie Est Belle. Our Privacy Policy explains our practices with respect to that information. We may need to send you email and text messages in order to, for example, verify your identity or provide you with important information. You authorize us to send those messages when you visit La Vie Est Belle and provide your contact details. Standard text or data charges may apply to text messages. Where offered, you may disable text message notifications by responding to any such message with “STOP”, or by following instructions provided in the message.

2. La Vie Est Belle IP

As between you and La Vie Est Belle, La Vie Est Belle and its licensors exclusively own all rights, title, and interest in the patents, copyrights (including rights in derivative works), moral rights, rights of publicity, trademarks or service marks, logos and designs, trade secrets, and other intellectual property embodied by, or contained in the La Vie Est Belle (collectively, “La Vie Est Belle IP”). La Vie Est Belle IP is protected by copyright, trade secret, patent, and other intellectual property laws, and all rights in La Vie Est Belle IP not expressly granted to you in these Terms of Use are reserved.

You may choose to or we may invite you to submit comments or ideas about improvements to La Vie Est Belle or our products or services (“Ideas”). If you submit an Idea to us, we will presume that your submission was voluntary, unsolicited by us, and delivered to us without any restrictions on our use of the Idea. You also agree that La Vie Est Belle has no fiduciary or any other obligation to you in connection with any Idea you submit to us, and that we are free to use your Ideas without any attribution or compensation to you.

3. Access to La Vie Est Belle

La Vie Est Belle grants you a limited, revocable, non-exclusive, non-transferable license to access La Vie Est Belle. This license does not include a right to use any of the content and information, logo, brand/brand identity and product listings/imagery. Your permissions or ability to use/access La Vie Est Belle are automatically terminated by any unauthorized use.

4. Products, Events, Content and Specifications

Details of the products or events available for purchase at La Vie Est Belle (“La Vie Est Belle Products”) are identified within the store of La Vie Est Belle. All features, content, specifications, products and prices of products described or depicted at La Vie Est Belle are subject to change at any time without notice. Unless expressly noted, all weights, measures and similar descriptions are approximate and are provided for convenience purposes only. Packaging may vary from that shown, and the appearance of a product in reality may differ from its appearance to you on La Vie Est Belle due to the limitations of the systems that you use to access La Vie Est Belle. The inclusion of any products or services in La Vie Est Belle at a particular time does not imply or warrant that these products or events will be available at any time. Occasionally, the manufacture or distribution of a certain product may be delayed for a number of reasons. In such event, we will make reasonable efforts to notify you of the delay and keep you informed of the revised delivery schedule. By placing an order, you represent that the products ordered will be used only in a lawful manner.

5. Your account

We may offer the opportunity to create an account to access La Vie Est Belle, including to make purchases. If we do so, you must provide accurate information about yourself when you create an account and ensure that you update us if that information changes. You must ensure that your login details remain confidential. You are responsible for any activity, including any purchases made, under your account. We reserve the right to terminate your account at any time and for any reason.

We accept the following payment methods and utilize U.S. currency:

7. Shipping and returns

This Section 7 applies to La Vie Est Belle Products that are physical goods. For clarity, this Section 7 applies despite any contrary terms in any invoice or purchase order.

Orders are shipped using carriers selected by La Vie Est Belle.

In most cases, but there may be some exceptions, La Vie Est Belle utilizes USPS Mail® for shipping goods and materials. This service includes tracking and delivery typically in 3-5 business days once shipment has been obtained by carrier. If we need to utilize a different shipping method or carrier, delivery may take longer.

The shipping fees you will be charged, if any, will be provided to you before you confirm your order. If we provide you with an estimated shipping date, the estimated delivery date is not guaranteed, and inventory shortages or events beyond our control could impact the delivery date. La Vie Est Belle is not liable for delivery later than the estimated delivery date, or for any loss, damage, or penalty you may incur from a delay in shipment or delivery. Unless otherwise noted in the product description, each La Vie Est Belle will be delivered FCA delivery location (as such location is designated on the applicable order) (Incoterms 2010).

Unless otherwise noted in the product description, La Vie Est Belle Products may be returned in their original packaging and condition (including all accessories and components provided) within 30 days of purchase.  Refer to our Return Policy for additional details.

8. Sanctions and export policy

You may not use La Vie Est Belle or purchase any La Vie Est Belle Product in or for the benefit of a country, organization, entity, or person embargoed or blocked by any government, including those on sanctions lists identified by the United States Office of Foreign Asset Control (OFAC). We do not claim, and we cannot guarantee that La Vie Est Belle or any La Vie Est Belle Product is or will be appropriate or available for any location or jurisdiction, comply with the laws of any location or jurisdiction, or comply with laws governing export, import, or foreign use.

9. No warranties

We provide La Vie Est Belle, La Vie Est Belle IP, La Vie Est Belle Products and La Vie Est Belle Events “as is” and “as available”, without any express, implied, or statutory warranties of title, merchantability, fitness for a particular purpose, noninfringement, or any other type of condition, warranty or guarantee. No data, documentation or any other information provided by La Vie Est Belle or obtained by you from or through La Vie Est Belle – whether from La Vie Est Belle or another entity, and whether oral or written – creates or implies any warranty from La Vie Est Belle to you.  La Vie Est Belle disclaims any knowledge of, and does not guarantee: (a) the accuracy, reliability, or correctness of any data provided through La Vie Est Belle; (b) that La Vie Est Belle Products will meet your specific needs or requirements; (c) that La Vie Est Belle will be available at any particular time or location, or will function in an uninterrupted manner or be secure; (d) that La Vie Est Belle will correct any defects or errors; or (e) that the La Vie Est Belle is free of viruses or other harmful code. Use of data, products or services that you access, purchase or download through La Vie Est Belle is done at your own risk – you are solely responsible for any damage to your property, loss of data, or any other loss that results from such access, purchase or download.

Nothing in these Terms of Use operates to exclude, restrict or modify the application of any implied condition, warranty or guarantee, or the exercise of any right or remedy, or the imposition of any liability under law to the extent that doing so would: (a) contravene that law; or (b) cause any term of this agreement to be void.

10. Limitation of liability

Under no circumstances will La Vie Est Belle be responsible or liable to you for any indirect, punitive, incidental, special, consequential, or exemplary damages resulting from your use or inability to use La Vie Est Belle or for the unavailability of La Vie Est Belle, or for lost profits, personal injury, or property damage, or for any other damages arising out of, in connection with, or relating to these Terms of Use or your use of La Vie Est Belle, even if such damages are foreseeable, and whether or not you or La Vie Est Belle has been advised of the possibility of such damages. La Vie Est Belle is not liable, and denies responsibility for, any damages, harm, or losses to you arising from or relating to hacking, tampering, or other unauthorized access or use of La Vie Est Belle or your failure to use or implement anti-fraud measures, security controls, or any other data security measure. La Vie Est Belle further denies responsibility for all liability and damages to you or others caused by (a) your access or use of La Vie Est Belle inconsistent with our instructions; (b) any unauthorized access of servers, infrastructure, or data used in connection with La Vie Est Belle; (c) any bugs, viruses, or other harmful code that may be transmitted to or through La Vie Est Belle; (d) any errors, inaccuracies, omissions, or losses in or to any data provided to us; (e) third-party content provided by you; or (f) the defamatory, offensive, or illegal conduct of others.

You agree to limit any additional liability not disclaimed or denied by La Vie Est Belle in relation to La Vie Est Belle, La Vie Est Belle IP, La Vie Est Belle Products and La Vie Est Belle Events to your direct and documented damages; and you further agree that under no circumstances will any such liability exceed in the aggregate the greater of the amounts paid by you to La Vie Est Belle during the three-month period immediately preceding the event that gave rise to your claim for damages, and USD $20.

These limitations on our liability to you will apply regardless of the legal theory on which your claim is based, including contract, tort (including negligence), strict liability, or any other theory or basis.

11. Disputes

a. Binding Arbitration: In the event that there is a dispute, claim or controversy arising out of or relating to statutory or common law claims, the breach, termination, enforcement, interpretation or validity of any provision of these Terms of Use, and the determination of the scope or applicability of your agreement to arbitrate any dispute, claim or controversy originating from these Terms of Use, but specifically excluding any dispute principally related to either party’s intellectual property (which such dispute will be resolved in litigation before the United States District Court for the District of Minnesota), will be determined by arbitration in Minneapolis/St. Paul, Minnesota or surrounding area before a single arbitrator. The arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules. The Expedited Procedures of the American Arbitration Association’s Commercial Arbitration Rules will apply for cases in which no disclosed claim or counterclaim exceeds $75,000 (exclusive of interest, attorneys’ fees and arbitration fees and costs). Where no party’s claim exceeds $25,000 (exclusive of interest, attorneys’ fees and arbitration fees and costs), and in other cases in which the parties agree, Section E-6 of the Expedited Procedures of the American Arbitration Association’s Commercial Arbitration Rules will apply. The arbitrator will apply the substantive law of the State of Minnesota, exclusive of its conflict or choice of law rules. If the American Arbitration Association is no longer in business, or refuses or declines to administer any dispute between the parties brought before it, either party may petition the United States District Court for the District of Minnesota to appoint the arbitrator. Nothing in this paragraph will preclude the parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. The parties acknowledge that this Agreement evidences a transaction involving interstate commerce. Notwithstanding the provisions in this paragraph referencing applicable substantive law, the Federal Arbitration Act (9 U.S.C. §§ 1-16) will govern any arbitration conducted pursuant to these Terms of Use.

Either party may commence arbitration by providing to the American Arbitration Association and the other party to the dispute a written demand for arbitration, setting forth the subject of the dispute and the relief requested.

b. Service of Process: Each party hereby irrevocably and unconditionally consents to service of process through personal service at their corporate headquarters, registered address, or primary address (for individuals or sole proprietors). Nothing in these Terms of Use will affect the right of any party to serve process in any other manner permitted by law.

c. Class Waiver: To the fullest extent permitted by law, each of the parties agrees that any dispute arising out of or in connection with these Terms of Use, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim or dispute proceeds in court rather than through arbitration, each party knowingly and irrevocably waives any right to trial by jury in any action, proceeding or counterclaim arising out of or relating to these Terms of Use or any of the transactions contemplated between the parties.

d. Provision of an Award: Subject to the limitations of liability identified in these Terms of Use, the appointed arbitrators may award monetary damages and any other remedies allowed by the laws of the State of Minnesota. In making a determination, the arbitrator will not have the authority to modify any term or provision of this Agreement. The arbitrator will deliver a reasoned written decision with respect to the dispute (the “Award”) to each party, who will promptly act in accordance with the Award. Any Award (including interim or final remedies) may be confirmed in or enforced by a state or federal court located in Minnesota. The decision of the arbitrator will be final and binding on the parties, and will not be subject to appeal or review.

e. Fees: Each party will advance one-half of the fees and expenses of the arbitrators, the costs of the attendance of the arbitration reporter at the arbitration hearing, and the costs of the arbitration facility. In any arbitration arising out of or related to these Terms of Use, the arbitrators will award to the prevailing party, if any, the costs and attorneys’ fees reasonably incurred by the prevailing party in connection with those aspects of its claims or defenses on which it prevails, and any opposing awards of costs and legal fees awards will be offset.

f. Confidentiality: The parties will maintain the confidential nature of the arbitration proceeding, the hearing and the Award, except (i) as may be necessary to prepare for or conduct the arbitration hearing on the merits, (ii) in connection with a court application as contemplated above for a preliminary remedy, or confirmation of an Award or its enforcement, (iii) our disclosure of the Award in confidential settlement negotiations, or (iv) as otherwise required by applicable laws. The parties, witnesses, and arbitrator will treat as confidential and will not disclose to any third person (other than witnesses or experts) any documentary or other evidence produced in any arbitration hereunder, except as required by law or except if such evidence was obtained from the public domain or was otherwise obtained independently from the arbitration.

g. Conflict of Rules: In the case of a conflict between the provisions of this Section 11 and the rules governing arbitration identified in Section 11.a, the provisions of this Section 11 will prevail. If any provision of these Terms of Use to arbitrate is held invalid or unenforceable, it will be so held to the minimum extent required by law and all the other provisions will remain valid and enforceable.

12. Rules for public comments

We love comments about our blogs, articles or social media, and we want to hear what you respectfully have to say. Remember to:  Be nice, courteous, respectful and stay on topic

  • No profanity, name-calling/personal attacks, or inappropriate content

  • If you harass others or joke about tragedies, you will be blocked

  • No spam posts, or posts trying to sell anything.

The primary rule here is pretty simple: Treat others with the same respect you’d want for yourself. Trolling and posting inappropriate content will lead to you being banned, and we don’t want that. Play nice.

Our moderators do their best not to delete comments.  We do, however, reserve the right to remove comments for the reasons mentioned above, as well as:  anything that violates our Privacy Policies; anything derogatory based on race, religion, color, national origin, disability, sexual orientation and/or otherwise derogatory in any perceived way; any other comments that are detrimental to the community.

Our moderators try to catch inappropriate content, but we also hope that our community will help us police it as well. If you see a comment that is inappropriate, we ask that you kindly email us at hello@shoplavie.co. We’ll review the comment and determine whether it should stay or go.

These guidelines are not intended and may not be relied upon to (and does not) create any right enforceable by any party other than our business. It doesn’t require our business to take (or even not take) any action.

Our business will sometimes change the technologies that run our websites. These include different software, hardware, and even web hosting. Some comments, especially older ones, may not be available in future versions of our sites.

Can’t find your comment on the site?

  • We do occasionally run into technical difficulties, and your comment may not have made it to our site.

  • We may not have approved it because it broke one of those rules listed above.

  • We may have deleted it because it violated the comment guidelines.

Why am I blocked from commenting?

While we do our best to let everyone have a voice in our online communities, sometimes commenters step over the line. We sometimes block and ban commenters who break the rules. Banning procedures use various technologies and information to enforce the block, including emails, IP addresses, and any other available information.

This stops the abusive commenter from commenting on the site in the future, even if later or other comments are not abusive. Depending on the software we are using at the time, banning might cause other previous comments from the abuser to disappear as well.

Copyright infringement in comments is not allowed.

13. Individual Donations

These Terms and Conditions apply separately to each single donation that you make on our website (shoplavie.co). Unless specified by you, they do not form a contract allowing for future or successive transactions to be set up. By confirming on the website that you wish to make a donation you agree to be bound by these Terms and Conditions for that donation.

(a) The donation services

We will use your donation at our discretion, but within our stated charitable objectives (as of March 15, 2021. 

All payments through the website are to be made by payment card.

Once you confirm through the website that you wish to proceed with your donation your transaction will be processed through our payment services provider, Shopify Payments (USA) Inc., via processor, Stripe, Inc. By confirming that you wish to proceed with your donation you authorize Shopify Payments and Stripe to request funds from your credit or debit card provider.

(b) Unauthorized card use

If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

(c) Information from you

Before we can process a donation you must provide us with (i) your name, address, phone number and email address; and (ii) details of the credit or debit card that you wish to use to fund the donation. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.

When you submit your payment details, these details will be transferred to our payment services provider, Shopify Payments (USA) Inc., via processor, Stripe, Inc, and your payment data will be collected and processed securely by them. You should make sure that you are aware of Shopify Payments and Stripe’s terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal data before you make a donation.

We won’t share your personal details with any other third party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.

(d) Refund policy

If you make an error in your donation please contact us by email at hello@shoplavie.co.

(e) General

We reserve the right to amend these Donation Payment Terms and Conditions at any time.

14. Applicable law

By using La Vie Est Belle, you agree that the laws of the state of Minnesota, USA, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and La Vie Est Belle.

15. Modification and severability

We have the right to change or add to the terms of these Terms of Use at any time, solely with prospective effect, and to change, delete, discontinue, or impose conditions on use of the La Vie Est Belle by posting such changes on our website.  You can access a copy of the current version of these Terms of Use on our website at any time. You can find out when these Terms of Use were last changed by checking the “Last updated” date at the top of the page.

La Vie Est Belle (“La Vie Est Belle”, “we”, “us” or “our”) respects your privacy. When it comes to your personal information, we believe in transparency, not surprises. That’s why we’ve set out here what personal information we collect, what we do with it and your choices and rights.

By visiting and utilizing La Vie Est Belle’s community and store, you confirm you have agreed to the Terms of Service and read and understood this Privacy Policy and our Return Policy.

1. Some key terms

In our Privacy Policy, when we refer to “Users”, we mean our customers who shop and purchase our goods and materials, including visitors to our site/pages.

2. How does this Privacy Policy apply?

This Privacy Policy describes what we do with personal information that we collect and use for our own purposes, such as your saved account information. 

We use cookies and similar technologies. See additional note below (line item 10).

3. Personal information we collect

We collect various personal information. This includes the following:

  • Information you provide to create a customer account, specifically billing and shipping address(es), details about your orders, email address, name, phone number.

  • Your marketing preferences.

  • The emails and other communications that you send us or otherwise contribute.  Please be aware that information on public parts of our sites is available to others.

  • Information you share with us in connection with surveys, contests or promotions.

4. How we collect personal information

We obtain personal information from various sources. We do this in three main ways:

  • You provide some of it directly (such as by registering for a customer account).

  • We record some of it automatically when you use our site (including with technologies like cookies).

  • We receive some of it from third parties (like when you make payments to us using our payment processor).

We’ve described this in more detail below.

a. Personal information you provide

When you use our website or online store, we collect information from you in a number of ways.  We also maintain your marketing preferences and the emails and other communications that you send us or otherwise contribute, such as customer support inquiries or posts to our community blog. You might also provide us with information in other ways, including by responding to surveys, submitting a form or participating in contests or similar promotions.

b. Personal information obtained from other sources

If you use a Third Party Service (such as Google) to register for a customer account, the Third Party Service may provide us with your Third Party Service account information on your behalf, such as your name and email address (we don’t collect or store passwords you use to access Third Party Services). Your privacy settings on the Third Party Service normally control what they share with us. Make sure you are comfortable with what they share by reviewing their privacy policies and, if necessary, modifying your privacy settings directly on the Third Party Service.

If you make a purchase on our website, we obtain limited information about your payment card from our payment processor, such as the last four digits, the country of issuance and the expiration date. Currently, our payment services provider is Shopify Payments (USA) Inc., via processor, Stripe, Inc. Shopify Payments and Stripe use and process your complete payment information in accordance with Shopify Payments and Stripe’s privacy policy. This paragraph is not applicable if you sign up for Paid Services as an in-app purchase via a mobile app store. Please see Google's privacy policy and Apple's privacy policy for information about how they use and process your payment information. 

5. How we use your personal information

We use the personal information we obtain about you for the following purposes:

  • Provision of products. Create and manage your customer account, provide and personalize our goods/services, process payments and respond to your inquiries.

  • Communicating with you. Communicate with you, including by sending you emails about your transactions and product-related announcements.

  • Surveys and contests. Administer surveys, contests and other promotions.

  • Promotion. Promote our products and send you tailored marketing communications about products, offers, programs and promotions of La Vie Est Belle and measure the success of those campaigns.

  • Advertising. We might analyze your interactions with our online store or social media, so we can tailor our advertising to what we think will interest you.

  • Security. Ensure the security and integrity of our online store.

  • Third party relationships. Manage our vendor and partner relationships.

  • To Host Website.  This website is hosted by Squarespace and Shopify (as of June, 2024). Squarespace and Shopify collect personal data when you visit this website, including:

    • Information about your browser, network and device

    • Web pages you visited prior to coming to this website

    • Your IP address

      Squarespace and Shopify need the data to run this website, and to protect and improve its platform and services. Squarespace and Shopify analyze the data in a de-personalized form.

  • Site Analytics.  Websites collect personal data to power our site analytics, including:

    • Information about your browser, network, and device

    • Web pages you visited prior to coming to this website

    • Your IP address

This information may also include details about your use of websites, including:

  • Clicks

  • Internal links

  • Pages visited

  • Scrolling

  • Searches

  • Timestamps

We share this information with Squarespace and Shopify, our website analytics providers, to learn about site traffic and activity.

We process your personal information for the above purposes when:

  • Consent. You have consented to the use of your personal information in a particular way. When you consent, you can change your mind at any time.

  • Performance of a contract. We need your personal information to provide you with products requested by you, or to respond to your inquiries. 

  • Legal obligation. We have a legal obligation to use your personal information, such as to comply with applicable tax and other government regulations or to comply with a court order or binding law enforcement request.

  • Legitimate interests. We have a legitimate interest in using your personal information. In particular, we have a legitimate interest in the following cases:

    • To operate the La Vie Est Belle business and provide you with tailored advertising and communications to develop and promote our business.

    • To analyze and improve the safety and security of our online store - we do this as it is necessary to pursue our legitimate interests in ensuring our website or online store is secure, such as by implementing and enhancing security measures and protections and protecting against fraud, spam and abuse.

    • To provide and improve our online community and store - we do this as it is necessary to pursue our legitimate interests of providing an innovative and tailored offering to our users on a sustained basis.

    • To comply with a court order or binding law enforcement request.

  • Protecting you and others. To protect your vital interests, or those of others.

We share personal information in the following ways:

  • Affiliates. We share personal information with our affiliates when it is reasonably necessary or desirable, such as to help provide goods/services to you or analyze and improve the goods/services we or they provide.

While no service is completely secure, our website or online store is hosted by Squarespace and Shopify (as of June, 2024).  Squarespace and Shopify have security teams dedicated to keeping personal information safe. They maintain administrative, technical and physical safeguards that are intended to appropriately protect against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing, of the personal information in possession. They employ security measures such as using firewalls to protect against intruders, building redundancies throughout their network (so that if one server goes down, another can cover for it) and testing for and protecting against network vulnerabilities.
